It can't be used in combat. It gets canceled and put on CD if you do. Considering Deathfire Touch, not an issue.
If they can activate it for your ult, you either wouldn't have done anything with your ult anyway, or they were specifically saving it.
The item costs as much as Zhonya's. Its not unfair that they can potentially block his ult with it.
