doesnt that strike anyone as counterintuitive and conflicting with his passive? i mean as an assassin, if you can assassinate a target, you want to assassinate him, and not let him walk and gamble for that ad bonus and give him a chance to heal or get saved by an ally.

it is OK if death mark proc just scores the assists. It doesn't have to be the killing blow, it just needs to proc.
Which might well be intentional: If Zed is able to kill his target without death mark proc, it is likely he either doesn't need anymore AD(if the target was close to full HP), or he doesn't deserve his reward(if the target was nearly killed by his teammates anyway).
On the other hand, if Zed is anywhere close to weak he will be buffed in next patch.
