When you're allowed to remake?

I was under the impression that you could remake so long as there was an ally on your team that was AFK from the start. Is that not the case? Two instances where something different happened:

1st, I had to uses the bathroom really bad when a game was starting, so I went to my tower and AFK'd for a couple minutes. On my return, my team had remade and I got a leaver buster warning.

2nd, a player on my team hadn't disconnected but was AFK for the first maybe 5 minutes of the game, and my team wasn't allowed to remake at the 3-minute mark.

Can someone explain this nonsense!?

Did the player move at all in the fountain? That might be a factor but I'm not really sure.

Nope, he was literally AFK. No items bought, no movement, nothing. He was just there.

But the thing is, even if he did move I was punished and my team remade when I had already left base. That's why this is confusing me.

For clarity, both games were Draft Pick.

As long as somebody is AFK for, I think, at least a min before the 3 min mark you can remake, doesn’t matter if you are in the base or not.

Well this guy was completey AFK for five minutes and we weren't allowed to remake. I tried multiple times and it said "You can only remake if an ally has disconnected" or something to that effect.
