Why does the damage on Duskblade of Drakkthar not have an internal CD?

Just tested this in a custom game as Kha'Zix. Walk out of bush hit enemy walk by into to brush wait 1 second and damage is up again. This isn't a healthly Mechanic, where is the counterplay to this? They have 5 SECONDS while being in vision of you to proc the passive.
