What if i dont say a single word in all chat, i flame in my team's chat, noone from my team reports me/gets offended, but an opponent reports me for flaming ? is it gonna be a valid report ? Does the system see who reported you and what chat to investigate ? i doubt it. But there you go. you get an undeserved valid report.

Twiggles2 votesI get where you're coming from, but in that case just use Skype or Curse Voice or something. That way you don't have to use the in-game chat AT ALL. Thus eliminating that risk from the equation entirely. Riot has stated time and time again what is and is not acceptable for the in-game chat. If you put something in the chat logs that was reportable and got reported, you have nobody to blame but yourself.

And i dont have to blame myself. The idea behind punishments is that you get punished for offending, insulting and creating a negative environment for other players in your games, not for doing these things to an imaginary player that does not even exist in the game.
SmokedAlmonds1 votesI really don't know how it would handle that situation. In theory it probably shouldn't punish you if no one could see your chat that reported you. That said, you are still doing something that is not allowed and it isn't unreasonable to think that the behavior isn't exclusive to those 5man premade games.

I know that Riot is aware of the issue because, if memory serves correctly, one of the very few overturned permabans was a situation like the one you're describing, but I might be mistaken about that so maybe someone else can shed some light on it.
