if riot wants to ban for chat. there should NOT be a mute button and heres why

it encourages players. rather than use positive communication.to use NO communication and automute/ping ignore because the general consensus is "if you type you get banned regardless of what you say or how you say it"

No, that's not the general consensus at all. The only people that have that idea are the people that got punished that for some reason think they did nothing wrong.

The mute feature is there to prevent someone from ruining your match further with their toxicity. It occurs with the presumed idea that the game was already damaged by a players toxicity. The report feature is there to ensure that no one else has to go through what you did.

it puts your team on a handicap. often. players dont know theyre muted. and may just try harder and harder to get x player's attention. usually in the form of ping spam or all caps /insults resulting in tilting the players who didnt mute. tilting the player trying to get people's attention. and resulting in people having to guess intentions

or. riot should add a "no chat" queue with 3rd party voice comms and pings only

The mute button isn't an excuse to be an asshole, because people should not have to use it in the first place. Them using it shows that there's a significant problem already, and it's their way of telling you to shut up.
