Can you bail out if you're against a confirmed hacker?

Just faced a team where upon every engagement, we would get disconnected, but their team wouldn't, resulting in them getting free kills. Went with about 10 deaths in 5 minutes. And NO, it was not "you suck"; everyone on our team was getting disconnected continuously, and their team was just spamming "HURR DURR, YOU SUCKS SUCK" in all-chat. It was like Standby-hacking for Halo 2 combined with T-bagging.

Please tell me bailing out is legal if you've confirmed you're against a hacker.

screen shot the names and report.

If your whole team agrees to bail then yes. If not then no.

Its not about being against a hacker, its about being their for the team.

F12 is default button for screenshots, take some. Send a ticket to support requesting an investigation into those players. If they are 'hacking' as you say, it will show up in the logs.
