Tbh it doesn't even matter if he was the original author or is now just a distrubutor by re-tweeting. A comment-less retweet signal complete agreement with the retweetet content, pretty much saying "if someone else didn't wrote it I would have written it". This is still happening in the States meaning the first amendment applies.
