Fiora is a champ that only does well, if the game goes past 40 min. Also, right now the game average length is 25 min. So is it trolling that I am doing crit build on Fiora?
If you are playing a champion in a way that you feel you perform well, with the intent to win, then no, you will not be banned for your gameplay choices.

No. Simply building crit on Fiora is not ban-worthy.
Although I will say it is suboptimal, except with IE for enhanced damage on your E's autocrit. A lifesteal-oriented build (I rush 
into 
>:D) is far nicer on her, given the sheer number of AA-resets you have allowing you to get a lot of high-AD attacks off quickly.
As a general rule of thumb, you have to either be toxic or deliberately feeding to be punished. Simply doing bad isn't ban-worthy, neither is doing an off-meta build (unless it's some shit like 6 
, which is an obvious indicator of trolling).
