What determines if a team can surrender with 3 votes in this situation? Sometimes a single "No" vote prevents surrender, sometimes the surrender happens anyway even though one person chose "No?"

When a surrender vote is called, at least 70% of the players that are in the game have to vote yes for a surrender to happen. That means that if all five players are in game, at least four need to vote yes. If one left, three of the four need to vote yes. If two or more leave, the vote has to be unanimous.
Edit: edited to 70% from 0%. That was kinda funny.
