Don't see why you have to die to get it back. It's in the defensive tree, which is supposed to help you NOT DIE.
Should also scale with level IMO gaining like 5 hp per level. I AM NOT SAYING 5 IS BALANCED. I AM SAYING SOMETHING LIKE 5.
