Just wondering because I think this is a great skin idea however I feel due to copyright this wouldn't be publishable, that is correct though, right?

Haha, well we couldn't have it looking so much like things in the Mario Universe - Nintendo wouldn't be too happy with us! That doesn't mean we wouldn't consider something like an 8-bit arcade Zyra skin inspired by Mario!

Hypothetically, if such skin was supposed to happen - what needs to be done?

I guess it's not a simple matter of "Hey Nintendo, we just want to make one skin using your IP as a base, here's a couple* of bucks, can we call it a deal?"

(if you can't go into detail you can just answer "No, it really isn't" :V )

*I do realize this 'couple' would actually have to be quite massive

They would likely have to give a portion of their profits from every skin sold using their IP. This would have no effect on the bowser skin, as it was a gift to beta testers, and never sold.

That said, the reality is that Riot would have to approach Nintendo asking how they could acquire rights to use said IP in their game, and Nintendo would then have to not only come to the plate, but would have to offer a few ways that Riot could use the IP, including but not limited to buying the IP flatout, giving a portion of profits to Nintendo on work using Nintendo's IP, Paying a (probably large) 1 time fee to use the IP in 1 scenario for profit, and many many more creative ways. Riot would then need to go over each and every one of these with Tencent, and see which, if any, of the offers were acceptable, and which best complimented their budget. Riot could make a proposal at this time, but Nintendo could very easily say no for any reason, so it's unlikely Riot would be able to get the rights on their terms. Riot, if it found an option it could both live with and that both Tencent and Nintendo could agree on, could obtain the rights.

Keep in mind, that there would likely be limits on how said IP could be used assuming that they didn't buy the IP flat out.

If they were to make the skin exactly like this, yeah there would be issues. Riot couldn't do it just willy nilly and the legal red tape would be murder, I think, to get it into the game otherwise. That said, they could do an interpretation on that, making an obvious nod/reference to other things while still keeping it original. Look at Augmented Singed, for example. He's a VERY clear reference to Bane from the Batman, but he's also still recognizable as Singed. There's also enough different there to make it obvious that while the skin is a nod to the character, it's not point for point ripping him off.

That's really the idea here, Make something that embraces to love and fantastic stuff that Nintendo has given us with Mario, while being original enough to be a thing that was clearly made for League.
