I'm pretty sure it doesn't matter if you been punished. None of the articles stating the icons needed to be in good behavior to get it.

Well I wanted the new icon but i cant gift while suspended. I get an error message. All i want is the icon :(

Hmmm, if anything you might have to have someone else gift you if they can? Didn't know people who got punished couldn't gift!

Do you get the icon if someone gifts you it?

I'll need to re-read it but I was under the impression that as long as it's gifted or if you gift someone you got it either way, but now I'm unsure!

Having read it, it seems like you need to gift someone. I would assume if you are unable to gift people you cannot get the icon. I'm sorry!
