The original creator has to post their work to the forums in order for Riot to have any capability to imitate or create it in game. The Terms of Use grants Riot the right to use and or imitate any original content posted by their creators, albeit at the expense of the creator not getting official recognition or income from their idea. But that's the double edged sword here - there's probably no other way to get your content a chance to make it into the game, unless you got a job for Riot.
