It protects people from the government silencing them. It has nothing to do with Riot banning a player for saying dumb stuff in chat. Please stop using that as a defense until Marc Merrill gets elected US President, then it's fair game.

Riot: Sure, but before you do, you have to follow the rules. Meaning you cannot flame, insult, use offensive slurs, or purposely try to ruin people's game. If you get caught, you'll be penalized, and eventually banned from our game. Also, we're not liable to you in any way if you do get banned. Means no refund. Now, are you sure you want to play our game and agreed to our terms?

Player: Yep! I agree with your terms!

Riot: Welcome to League of Legends!

Player: (Goes against terms and break the rules by flaming)

Riot: .... (penalizes player)

Player: How dare you punish me! You punished me for no reason. I have rights! I have freedom of speech! I can say whatever I want! I WANT A REFUND!

What a lot of people don't realise is yes, they do have the freedom to say whatever the hell they like, but they also have to acknowledge that it doesn't mean that they aren't responsible for the consequences their "free" speech can incur.

Even if free speech protects you from the government silencing you, there are still limitations to how much it protects you from the government. If you yell FIRE! in a crowded theater or incite violence against another with your free speech, the government can still ban (jail) you from society. Free speech provides ZERO protection from Rito ToS.

A group gets formed called "The Brothers of Virtue". They go around beating up anyone who says the word 'bagels'. Bagel shops around the country suffer as any attempts to advertise or discuss their business are met with violence. People self-censor out of fear of brutalization and 'bagels' becomes a forbidden term only spoken in hushed whispers outside of the line of sight.

But hey they totally have freedom of speech because it's not the _government _ doing it, right?
