You were given multiple warnings before this in the form of smaller punishments, and signed a terms of service where you agreed to let Riot handle and punish your account however they see fit.

You've got nothing on them to sue over.

Your ban looks justified to me, but for those that somehow think you have a shred of a case against Riot Games, let me debunk that notion for you immediately (with one exception):

  1. You agreed to the Terms of Use and the End User License Agreement prior to playing this game.

  2. You are given the privilege to use digital content which may be revoked at any time, for any reason, or no reason at all. You do not own this content and that access is temporary.

  3. "But what if a minor (a person under the age of 18/17---depending upon jurisdiction) agrees to this contract? Minors can't enter legally binding agreements". This is a much more interesting situation, however starting a "class action suit" will net you absolutely nothing because in a class action suit, the lawyers get most of the money and the hordes of plaintiffs get zero.

ON THE OTHER HAND, if you file a small claims case---which is what your case would fall under because the damages are less than $5,000-$7,500 (which is hte statutory maximum for small claims in most states), then you may have a chance. Remember, in small claims court, there are no lawyers, it's just the litigants involved... plaintiff and defendant in front of a judge. All you would have to do is prove you were a minor at the time of the transaction and boom, you win.

The adults that want to claim they could get legal help are out of luck, however, because you do have the ability to enter a legally binding contract and you have no case.

-- All Riot would have to do to avoid this is simply put in a checkbox upon any purchase that says "I certify that I am over the age of 18 and can legally purchase this content". Doing so essentially covers them, because it means that if you click that link you are stating that you're of the age of majority and you can legally enter a contract. If you aren't over the age of 18 and click that link, then you are committing fraud and Riot could simply have the defense, "they said they were 18, we made a reasonable effort to engage in a good faith contract".

Man.. it's been a while since I saw a lawsuit threat.

Thanks for making my day.

You totally should. Make sure you get a real expensive one, and don't stop until you find one that will take the case. Make sure you disregard their opinion, and take it to court.

perm ban on $400.00 value account, and every game I had I had a troll, feeder, and toxic person, this system is bullshit, and riot is corrupted to allow feeders vs someone spitting honest feedback on a shitty system, calling my bank tommorow

My family member (who works in civil rights law btw) said you need to demand your money from RIOT under threat of suit. You will most likely be refunded just for not being a gullible troll like these kids. Why? Because RIOT Games lawyers know that there is a probability that they could lose the case. You should especially threaten them with a class action. Why? Even at a 2% chance of success the loss of even $1MM would be an EV of $20,000.

AND Boom goes nothing because you may not actually be bound to those terms by any number of legal flaws in the contract. The main one being, who the fuck says that when I purchase a digital asset (i.e. a skin or champions) that I do not in some way own that skin with regards to my account. RIOT can say literally anything here in their contract if they want to. Imagine if a car sales company has a contract that states that if your payment is more than a day late you need to pay them $10,000.

my argument has literally nothing to do with whatever RIOT has in the contract and everything to do with how to negotiate from a position of strength. No RIOT games the now billion dollar company doesn't give a shit about it's players wanting their money back but I bet they give you a little more audience if you approach the scenario like an astute professional.

OP this is a lesson in the real world. Some people get screwed and some get screwed then learn the game.

Choose whether you wanna be like these poor souls trying to uphold a system just because you think you cant beat it or if you want to actually put your hat in the ring and fight for what you know to be fair. I guarantee you courts in this country are not as strongly opined as the people in this comments section are trying to convince you.

No kidding I gave a bad example because I meant to give a bad example. The bad example is exactly the point that you're casually glossing over because that's where this guy has a case. The fact of the matter is, when it comes to digital property, there is no precedent because it is a brand new responsibility that human beings are embarking on (and RIOT is failing miserably at imo).

ToS'/contracts like the ones in LoL may very well be future case studies in shitty ways that businesses used to handle digital property

I've seen worst and better.

mnstryvii3/23/2018, 3:58:05 PM1 votes

I'm sure RIOT believed that their gamers were smart enough to dig through their contracts after haphazardly coming up with a new system to battle toxicity rofl. Are you really that naive to not know how many times people have won cases like this???

mnstryvii3/23/2018, 4:00:06 PM1 votes

You people seem to think gamers are still just bums living with mom. I've worked in PE, investment banking and have friends family in big law. This shit is far from unwinnable

No MMO developer is contractually obligated to refund your money when you break their rules and are punished. You do not get paid when your punishment is YOUR fault. That's not the way this works, fam. This isn't a voided contract, this is a BROKEN contract. You are obligated to follow the rules, and when you break the rules you're punished. This guy broke the rules and was punished in a way outlined. The end. I don't know why this is even an argument.
