How do you know he didn't get punished? For all you know he did. Regardless though telling someone to kill themselves will always result in a punishment as it's unacceptable in any context, so playing the innocent card won't help you here. Post your chat logs if you're looking to have an actual discussion about your ban.
P.S. Not saying that he's innocent either (assuming what you said is true), but someone else behaving poorly doesn't mean your own poor behavior gets a free pass.
