My lawyer read the terms and conditions of lol and thinks i should take legal action against riot since i was in the terms and i have a witness willing to testify that they were the reason for my ban. i submite a request that someone was playing my account when they gave me a ban for toxicity and they denied it. If there is any other option please let me know. I am just waiting to get a response, to see if ill get a refund. I haven't even played this game in 2 years since ive been banned.

You won't. Ever. Before you even downloaded the game you agreed to these terms.

  1. Account Termination 2.2. What happens if my account is terminated? (No LoL for you.) If your account is terminated, you’ll no longer have access to it, including any of the associated data or content (e.g., champions, skins, Riot Points, etc.). You’ll not be entitled to any refunds and we’ll have no liability to you. We also reserve the right to terminate any other accounts you may have created, as well as your access to any other Riot Services (also without any refunds or liability to you). You understand and agree that using the Riot Services comes with the risk that your account may be terminated or suspended and that, whenever you use the Riot Services, you’ll bear this risk in mind and always conduct yourself appropriately.

Which is like signing a contract. Which means anything you signed and agreed to will be used against you in court. So, you're not going to be getting anything. Not even your account. Regardless, you lose to Riot no matter what.

Might I suggest you pick someone besides your baby brother to be your lawyer?

Your “lawyer” is an imbecile.

Source: am lawyer who has actually read the TOS for league.

You know league's ToU literally states that you are held responsible for your own account's security? If someone else accesses your account and gets it banned, you're responsible for it. Not to mention the same ToU says that Riot aren't going to refund you if you get banned.

No, you cannot get a refund. It says it when you purchase RP in the client, and it says it on the back of pre-paid Riot Point cards - the transaction is not refundable. Once you've spent money on your account, that money has gone to Riot and cannot be refunded.

And if you have a lawyer and they read the terms and conditions, they wouldn't think you should or could take legal action against Riot, because there's no legal action to take. You paid money in a non-refundable transaction, and Riot revoked your access to their services, as their TOU states they are fully allowed to do. Any legal action on your part would simply backfire because you have no grounds for it.

If a lawyer thinks you should take legal action, and you trust them, and you have the money set aside in case it doesn't go well for you, then why not?

Might want to look into a getting a second opinion though. Better safe than sorry and all that.

Your lawyer should put glasses on next time since he clearly missed the part where you release Riot from any liability for account bans.

You shared your account, that alone is a banable offense, much less you have no way of proving you weren't the one on the account when it was banned for being toxic and again, that wouldn't matter anyways because of my first point.

question, did you allow the person to play on your account?

Good luck with your legal action. I have yet to see someone win a case against riot legally apart from some skin-related things like the whole Striker Lucian debacle.
