I doubt he "stole" it. You probably failed and smited while he was attacking it with you, and your smite left it on low hp. So his auto attack finished it. He shouldnt get banned. He didnt break any rules. But if u harassed him about it, then YOU should get banned. Also this has nothing to do with solo queue.
Also since u intentionally fed that game and since u have alot of intentional feeding in your match history, i am sure permanent ban is on your way.
