Sure it does. The main context is whether you flamed. If so, it's punishable, regardless of whether it was in instigation or retaliation.
if your definition of that is "but they started it !!!111!!!1!" being valid then no, if its something like telling someone to kill themselves in aram because of their gold and lack of item then yes
