My restaurant got shut down by the health department, out of work till we pass a re-inspection

All because one of my idiot prep cooks decided to half ass cleaning his prep station and leave one of the baking ovens on overnight burning the fuck out of at least 50 servings of cheesy garlic bread. He has been with us for over 2 years and this is really his first fuck up so i don't want to fire him, I think it would be best to make him pay the fine out of his check since he was responsible for the hits we got, but at the same time he just had twins with his wife, still has to pay those bills, and I fear if I slap this fine on him he may quit. I honestly like the guy, for the most part he is efficient and like I said he isn't a normal screw up. I would pay the fine myself but I'm kinda in debt since I took classes in Culinary Arts and can't afford to cover for him. Only thing I could do is talk to the owner (my boss) and convince him to pay it with the profits but when he hears what happened he may have me force the prep cook to pay.... or worse.

It is a really shitty situation right now.

It's not legal to force en employee to pay for a fine such as that out of his own pocket. That responsibility is that of the owner. Unless there is a contract which was signed when he was hired which would allow the owner to dock his pay. Unless you can cite a law that allows this to the best of my research into this subject it is in fact illegal.

If you boss does force the cook to pay then he has grounds for a lawsuit. I imagine that this fact should be brought up during the conversation.

and yah you should bop the guy, but do it in bits over time (like... $30 a pay day or something) so that way he still has some money to work with

If he is a good employee like you describe, he will probably quit the moment you decide to dock his pay.

The best employees know that they have options. The bad ones don't care about the job, and the mediocre ones will cling.

speaking from experience here if u force a worker to pay for this they will prob quit. Accidents happen but by forcing a person to pay for any mistake they made is a sure fire way to say " I dont give a @#$% about my employee's". Worked at a resturant that did that to one of the cooks for burning a steak and the entire kitchen staff said #$%^ you and walked out. That is way worse for business.

You should inform the owner and see what they want done. It's a business, it needs to be handled as such, regardless of feelings towards another employee.
